Public offer to conclude a donation agreement

Autonomous non-profit organization for the development of cycling "FAT RACING CLUB (RACING)" (OGRN 1255300002616, TIN 5300020110), hereinafter referred to as the "Recipient", represented by General Director Ilya Vladimirovich Fateev, acting on the basis of the Charter, offers any capable individual or legal entity, hereinafter referred to as the "Donor", to conclude a donation agreement for the conditions set out below.

1. Subject of the agreement

1.1. The Donor shall gratuitously transfer funds (donation) to the Recipient for generally useful purposes — for the development of cycling, the organization and conduct of amateur cycling competitions and events, the support of amateur athletes and other statutory goals of the Recipient.

1.2. This offer is a public offer in accordance with paragraph 2 of Article 437 of the Civil Code of the Russian Federation. A donation is recognized as a donation within the meaning of Article 582 of the Civil Code of the Russian Federation.

1.3. The transfer of funds under this agreement does not entail any counter obligations to the Donor for the Recipient.

2. Contract conclusion procedure

2.1. Acceptance of this offer is the transfer of funds by the Donor to the Recipient by any of the methods indicated on the website fatracing.ru/donate, including by bank transfer using the Recipient's banking details.

2.2. The Agreement is considered concluded at the time of receipt of funds to the Recipient's current account.

2.3. The amount of the donation is determined by the Donor independently.

2.4. When transferring by bank transfer, the Donor is recommended to indicate the purpose of the payment: "Voluntary donation for statutory purposes. VAT is not charged.". The absence or other wording of the purpose of the payment does not cancel the fact that the transfer was made in the order of acceptance of this offer.

3. Purpose and use of donation

3.1. If the Donor has not specified a specific purpose, the donation is used by the Recipient for statutory purposes at his discretion, including administrative expenses necessary to achieve statutory goals.

3.2. If the donation is made within the framework of the target collection announced on the website, it is used for the purposes of this collection.

3.3. If, according to the announced target collection, an amount exceeding the required amount has been collected, or the purpose of the collection has become unattainable, the Recipient has the right to direct the appropriate funds to other statutory purposes, about which he publishes a message on the website. By making a donation, the Donor agrees with this procedure (paragraph 4 of Article 582 of the Civil Code of the Russian Federation).

3.4. The recipient keeps separate records of all operations on the use of donations received for a specific purpose.

4. Reporting

4.1. The recipient publishes information on the receipt and expenditure of funds of target fees on the website fatracing.ru.

4.2. At the written request of the Donor, directed to fatracing@yandex.ru, The recipient shall provide a signed copy of the donation agreement and information on the use of the donation within 30 calendar days. The documents may be used by the Donor — an individual to receive a social tax deduction in accordance with subparagraph 1 of paragraph 1 of Article 219 of the Tax Code of the Russian Federation.

5. Other conditions

5.1. Donations are accepted from citizens of the Russian Federation and Russian legal entities. The recipient has the right to refuse the donation and return the money to the sender, including if the payment came from a foreign source or if accepting the donation contradicts the goals and interests of the Recipient.

5.2. By making a donation, the Donor confirms his consent to the processing of his personal data to the extent necessary for the execution of this agreement and the fulfillment of legal requirements, in accordance with Personal Data Processing Policy.

5.3. The Recipient has the right to change the terms of this offer; the changes take effect from the moment the new version is published on the website and do not apply to donations made before publication.

5.4. The invalidity of certain provisions of this offer does not entail the invalidity of the agreement as a whole.
